A Montana man on Feb. 26, was arrested and booked into Sonoma County Jail on charges of lewd and lascivious acts with a minor and attempted unlawful sex with a minor.

According to a Rohnert Park Dept. of Public Safety (RPDPS) report, Jonathan Wayne Smith, 35, was found in the backseat of a vehicle with a 15-year-old girl in the parking lot of Sunrise Park, located at the corner of Snyder Lane and Rohnert Park Expressway.

At approximately 12:30 p.m., motorcycle Officer Ryan Foiles was on his normal traffic assignment when he observed a suspicious vehicle in the Sunrise Park parking lot.

He contacted the occupants of the vehicle and found Smith in the backseat with the girl. Upon subsequent investigation, it was determined a second girl had been present in the vehicle but had left before Foiles arrived.

Smith, the report said, apparently had befriended the girls over the previous weekend at a local shopping mall, had been in communication with them via cellphone and coordinated their rendezvous. He allegedly picked up the girls at University Square Shopping Plaza and took them to two different motels in RP. Unable to get a room, they chose to go to Sunrise Park.

Smith’s bail was set at $30,000 and he has since been released from Sonoma County Jail.
